1. Introduction and Acceptance

These Terms and Conditions ("Terms") govern Your access to and use of the website located at https://www.therightenergy.net (the "Platform"), and the purchase of products and consultation services offered through the Platform (collectively, the "Services"), operated by The Right Energy Private Limited, a company incorporated under the Companies Act, 2013, having its registered office in Indore, MP, India, the full registered address being available upon request ("The Right Energy," "Company," "We," "Us," or "Our").

These Terms constitute a legally binding agreement between You and The Right Energy. By accessing, browsing, registering on, or transacting through the Platform, You acknowledge that You have read, understood, and unconditionally agree to be bound by these Terms, together with Our Privacy Policy, Cookie Policy, Shipping Policy, and Refund, Returns and Cancellation Policy referenced herein. If You do not agree to these Terms, You must not access or use the Platform.

These Terms are published in accordance with the provisions of Rule 3(1)(a) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and constitute an electronic record under the Information Technology Act, 2000. They do not require any physical or digital signature.

2. Eligibility

The Services are available only to persons who: (i) are at least eighteen (18) years of age; (ii) are competent to enter into a legally binding contract under the Indian Contract Act, 1872; and (iii) have not been previously suspended or removed by Us from the Platform. By using the Platform, You represent and warrant that You meet all eligibility criteria. Minors are prohibited from registering on or transacting through the Platform.

3. Products and Services

The Right Energy offers, through the Platform, the sale of spiritual wellness and energy-related products, including but not limited to orgone pyramids, crystals, Vastu energy tools, and related items ("Products"), as well as paid consultation services, including Vastu consultations, energy healing, and crystal guidance, delivered in-person, via video call, or via chat ("Consultation Services").

4. Account Registration

Certain Services may require You to create an account. You agree to provide accurate, current, and complete information during registration and to maintain and update such information. You are solely responsible for safeguarding Your account credentials and for all activities that occur under Your account. You must notify Us immediately of any unauthorised use of Your account. We reserve the right to suspend or terminate Your account at Our sole discretion in the event of breach of these Terms.

5. Order Placement and Acceptance

Your placement of an order on the Platform constitutes an offer by You to purchase the selected Product or Consultation Service at the listed price. Such offer shall be deemed accepted by Us only upon issuance of an order confirmation by email or other electronic means. The contract of sale between You and Us shall be deemed to be concluded upon the issuance of such order confirmation.

We reserve the right, at Our sole discretion, to accept, refuse, or cancel any order, including (without limitation) where there is an error in the listed price or product description, where the Product is unavailable, where the order is suspected to be fraudulent, or where the delivery address falls outside Our serviceable areas.

6. Payment

All payments shall be made through Our authorised online payment gateway, Razorpay Software Private Limited. By initiating a payment, You agree to Razorpay's own terms of service and privacy policy. We do not store any full card numbers, CVV, PIN, OTP, UPI credentials, or net banking passwords on Our servers; all such information is captured and processed directly by Razorpay over secure, PCI-DSS-compliant channels.

You represent and warrant that the payment instrument used by You is lawfully owned by You and that You are duly authorised to use such instrument. We shall not be liable for any loss arising out of unauthorised, fraudulent, or erroneous use of any payment instrument.

7. Payment Gateway Disclaimer

You acknowledge and agree that Razorpay is an independent third-party service provider. The Right Energy does not control, operate, or guarantee the availability, accuracy, or security of Razorpay's services. The Right Energy shall not be liable for any loss, damage, claim, demand, cost, or expense arising directly or indirectly out of: (i) any failure, delay, interruption, or error in the processing of a payment by Razorpay; (ii) any unauthorised access to, or fraudulent use of, Your payment instrument; (iii) any decline, reversal, chargeback, or non-credit of a transaction by Your card-issuing bank, UPI service provider, or other financial institution; or (iv) any technical malfunction or system outage of Razorpay or any associated banking infrastructure.

Where an amount is debited from Your account but Your order is not successfully confirmed on the Platform, You shall first raise the matter with Razorpay and/or Your issuing bank. We shall, on a best-efforts basis, assist with reconciliation, but Our liability shall in no event exceed the actual amount received and retained by Us against the specific transaction. The foregoing shall not exclude any liability for deficiency of service directly attributable to Us under the Consumer Protection Act, 2019.

8. Shipping, Delivery, Returns and Refunds

Shipping and delivery of Products are governed by Our Shipping Policy, and cancellations, returns, and refunds are governed by Our Refund, Returns and Cancellation Policy, both of which are incorporated herein by reference and available on the Platform.

9. Consultation Services

Paid consultation services, including Vastu consultations, energy healing, and crystal guidance, delivered in-person, via video call, or via chat, are offered as personal-development and spiritual-wellness services. They are not medical, psychiatric, psychological, legal, or financial services and shall not be relied upon as a substitute for advice from a qualified professional. Results from Consultation Services are inherently subjective and may vary from person to person. The cancellation and rescheduling of Consultation Services shall be governed by Our Refund, Returns and Cancellation Policy.

10. Intellectual Property

All content on the Platform — including text, graphics, logos, product images, photographs, descriptions, and the trademark "The Right Energy" — is the property of The Right Energy or its licensors and is protected under Indian and international copyright, trademark, and other intellectual property laws. No content from the Platform may be copied, reproduced, modified, distributed, or used in any manner without Our prior written consent.

11. Acceptable Use

You agree to use the Platform only for lawful purposes and in compliance with these Terms. You shall not engage in any activity that interferes with the operation of the Platform, attempts to gain unauthorised access to any account or system, transmits viruses or malicious code, scrapes or harvests data through automated means, or violates any applicable law or third-party right.

12. Disclaimers and Limitation of Liability

The Platform and the Products and Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, save to the extent such warranties cannot be lawfully excluded under applicable law. Without prejudice to any deficiency-of-service liability under the Consumer Protection Act, 2019, Our aggregate liability arising out of or relating to these Terms or any transaction undertaken on the Platform shall, in any event, be limited to the amount actually paid by You to Us for the specific transaction giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless The Right Energy and its directors, officers, employees, affiliates, and agents from and against any and all claims, demands, losses, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with Your breach of these Terms, Your violation of any applicable law or third-party right, or Your misuse of the Platform.

14. Force Majeure

We shall not be liable for any failure or delay in performance of Our obligations under these Terms arising out of or caused by, directly or indirectly, forces beyond Our reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, war, terrorism, riots, civil unrest, government action, labour disputes, fire, flood, accidents, network or telecommunication failures, or interruptions of internet services.

15. Grievance Redressal

In accordance with the Information Technology Act, 2000, the Consumer Protection (E-Commerce) Rules, 2020, and the Digital Personal Data Protection Act, 2023, any grievance regarding these Terms or a transaction may be addressed to Our Grievance Officer, whose contact details are set out below. The Grievance Officer shall acknowledge each grievance within twenty-four (24) hours of receipt and shall endeavour to redress the same within fifteen (15) days.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Subject to any applicable dispute resolution provisions, the courts and tribunals at Indore, Madhya Pradesh shall have exclusive jurisdiction over any matters arising out of or in connection with these Terms.

17. Amendments

We reserve the right to amend, modify, or update these Terms at any time without prior notice. Any such amendments shall be effective upon posting on the Platform. The Terms applicable to a particular transaction shall be the Terms in force as of the date of order confirmation.

18. Severability and Entire Agreement

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be deemed modified to the minimum extent necessary to render it valid and enforceable, and the remaining provisions shall continue in full force and effect. These Terms, together with the Privacy Policy, Shipping Policy, and Refund, Returns and Cancellation Policy, constitute the entire agreement between You and Us in respect of transactions on the Platform.
